AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and GEM Consultancy Sdn. Bhd. (“we”,”us” or “our”), concerning your access to and use of the GEM Consultancy Sdn. Bhd. website as well as any other media form, media channel, mobile website or mobile application related, linked or otherwise connected thereto (collectively, the “Service”).

You agree that by accessing the Service, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Service and you must discontinue use immediately.

Intellectual Property

All copyright, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) in and on the Service belongs to GEM Consultancy Sdn. Bhd. and/or third parties. Membership

Membership of the Service is personal and its membership and benefits cannot be used by anyone other than the individual members. By way of example, and not as a limitation, you agree not to use the Service:

To abuse, harass, threaten, impersonate or intimidate any person;

To post or transmit, or cause to be posted or transmitted, any Content that is libellous, defamatory, obscene, pornographic, abusive, offensive, profane, of that infringes any copyright or other right of any person;

To promote or sell Content of another person.

Our Service may contain links to third-party web sites or services that are not owned or controlled by GEM Consultancy Sdn Bhd. GEM Consultancy Sdn. Bhd. has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that GEM Consultancy Sdn. Bhd. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 45 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Termination

You may terminate your account, any associated email address and access to the Service by submitting such termination request to GEM Consultancy Sdn Bhd.

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Term which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
